LEGAL TERMS AND CONDITIONS OF THE “KOMBAT OSORNO 2025 PADEL RACKET SIGNED BY MANU MARTÍN” DRAW – PADEL MARKET OUTLET

1. ORGANIZER

The giveaway is organized by EUROPEAN PADEL MARKET, S.L. (hereinafter, “PADEL MARKET”), with tax identification number CIF B05379060 and registered office at C/ Doctor Esquerdo 105, 28007, Madrid (Spain).

2. PURPOSE OF THE GIVEAWAY

The purpose of the giveaway is to promote the Padel Market Outlet physical store and encourage subscriptions to the PADEL MARKET newsletter through voluntary participation in this giveaway.

3. TERRITORIAL SCOPE AND PARTICIPANTS

3.1. Eligibility

The giveaway is open to natural persons who:

  • Are 18 years of age or older at the time of participation.

  • Reside in Spain.

  • Fully comply with the participation mechanics described in these terms.

3.2. Exclusions

The following individuals are excluded:

  • Employees of PADEL MARKET, as well as their first-degree relatives.

  • Any person professionally involved in the organization or execution of the giveaway.

4. DURATION

The participation period will run from February 16 to March 1, inclusive, until 11:59 PM (Spanish mainland time) on the final day.

The winner will be announced on March 2 on PADEL MARKET’s social media channels and will be contacted via email.

5. PARTICIPATION MECHANICS

To participate, the user must:

  1. Visit the Padel Market Outlet store located at Calle Trueno 30, Leganés (Madrid).

  2. Scan the QR code available in the store.

  3. Complete the form with the required information.

  4. Subscribe to the PADEL MARKET newsletter and submit the form.

Participation condition

To participate, it is necessary to complete the form and subscribe to the PADEL MARKET newsletter. Participants may revoke their consent and unsubscribe at any time. Any later unsubscribe will not affect the validity of entries already registered during the giveaway period.

Only entries that correctly complete the above process within the participation period will be considered valid.

6. PARTICIPATION LIMITATIONS AND CONTROL

6.1. One (1) entry per person (and per email address).

6.2. PADEL MARKET may invalidate entries that are:

  • Duplicate or fraudulent

  • Submitted using false or incomplete information

  • Generated by automated means

  • In violation of these terms or applicable regulations

7. PRIZE

The prize consists of:

  • 1 KOMBAT OSORNO 2025 padel racket by Manu Martín, signed by the coach and influencer Manu Martín.

The prize:

  • Cannot be exchanged for cash or other products/services

  • Is personal and non-transferable, unless PADEL MARKET decides otherwise for justified reasons

  • Is subject to availability. If delivery becomes impossible due to force majeure, PADEL MARKET may replace it with another prize of equal or greater value.

8. SELECTION OF THE WINNER

8.1. The winner will be selected through a random draw among all valid entries received during the participation period.

8.2. Two (2) alternate winners will also be selected in case the main winner cannot be contacted or does not meet the eligibility requirements.

9. RESULT ANNOUNCEMENT AND PRIZE DELIVERY

9.1. The winner will be announced on March 2 on PADEL MARKET’s social media channels (while limiting or hiding personal data where appropriate).

9.2. PADEL MARKET will contact the winner via the email address provided in the form.

9.3. If within 7 calendar days from the first contact the winner:

  • Does not respond, or

  • Cannot prove compliance with the requirements (age, residence, etc.),

the prize will be offered to the next alternate winner, in order of selection.

9.4. Prize delivery Store pickup (preferred): The winner may collect the prize at Padel Market Outlet upon identification.

Shipping to the winner (alternative): If the winner cannot collect the prize in person, PADEL MARKET will ship it to the address provided by the winner and may request additional contact details (address and phone number) solely for shipping purposes.

9.5. PADEL MARKET will not be responsible for delays caused by third parties (e.g., courier services) or for issues resulting from incorrect or incomplete addresses provided by the winner.

10. TAXATION

If applicable, the prize may be subject to taxation in accordance with current regulations. PADEL MARKET will comply with applicable tax regulations at all times.

11. DATA PROTECTION (GDPR AND LOPDGDD)

11.1. Data Controller

11.2. Purpose of Data Processing

  • To manage participation in the giveaway, validate participants, and communicate results.

  • To deliver the prize to the winner (including shipping management if applicable).

  • Newsletter subscription and sending of commercial communications.

11.3. Legal Basis

  • Giveaway management: execution of the giveaway and application of these terms.

  • Newsletter: participant consent.

11.4. Data Retention

Data will be stored for the duration of the giveaway and afterward for the period necessary to meet legal obligations.
For the newsletter, data will be retained until the user unsubscribes.

11.5. Recipients

Data will not be shared with third parties except:

  • When legally required

  • With service providers necessary for management (e.g., form platforms, email marketing platforms, or shipping companies) under a data processing agreement, where applicable.

11.6. Data Subject Rights

Participants may exercise their rights of:

  • Rectification

  • Deletion

  • Restriction

11.7. Newsletter Unsubscribe

Users may unsubscribe at any time via the link included in communications.

12. PUBLICATION OF THE WINNER ON SOCIAL MEDIA

To ensure transparency, participants accept that if they are selected as the winner, PADEL MARKET may publish their first name and first surname (or first name and first initial of the surname) on its social media channels and/or website solely to communicate the giveaway result.

Participants may withdraw their consent before publication. In such cases, PADEL MARKET may announce the winner using an alternative identification format (e.g., name + initials or participation number), without affecting the private communication required for prize delivery.

13. LIABILITY

PADEL MARKET is not responsible for:

  • External technical failures (QR code scanning issues, network failures, user device errors, etc.)

  • Entries not registered due to causes beyond PADEL MARKET’s control

PADEL MARKET reserves the right to modify, suspend, or cancel the giveaway for justified reasons, informing participants through its usual communication channels.

14. ACCEPTANCE OF THE TERMS

Participation in the giveaway implies full acceptance of these terms and conditions. Any declaration of non-acceptance will result in exclusion from the giveaway.

15. APPLICABLE LAW AND JURISDICTION

These terms are governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of Madrid, unless mandatory regulations provide otherwise.

16. PLATFORM DISCLAIMER

This giveaway is not sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, or any other platform where it may be communicated.
